條款

1. Deposit Clause 訂金條款

• 客戶一旦支付訂金，即表示已閱讀、明白並同意以下所有條款及細則。

• 本發票所列之所有產品均享有保養服務。D-BOX 產品、ARC 自家產品或由 ARC 指定之產品，其保養將由 ARC 直接提供。

• 其他所有產品，其保養政策及服務均由相關授權分銷商或供應商決定。客戶如需查詢或申請保養，可聯絡 ARC 客服以獲取更多詳情及協助。

• Once a deposit is made, the Customer is deemed to have read, understood, and agreed to all of the following Terms and Conditions.

• All products listed in this invoice are covered by warranty. For D-BOX products, ARC’s own products, or other products specifically designated by ARC, the warranty will be provided directly by ARC.

• For all other products, the applicable warranty policy and service shall be determined by the respective authorized distributor or supplier. Customers may contact ARC for further details and assistance regarding warranty claims.

2. Payment Terms 付款條款

• 所有款項必須於送貨前結清，除非另有書面協議。逾期付款或須繳付額外費用。

• Full payment must be settled before delivery unless otherwise agreed in writing. Late payments may incur additional charges.

3. Cancellation & Refund Policy 取消及退款政策

• 訂單一經確認，已支付的訂金概不退還。

• 如客戶取消訂單，本公司將收取處理費。處理費由 ARC 根據訂單進度、已產生的成本及其他應付費用而定。

• 客戶須於發出取消通知（包括短信、電郵或其他書面形式）後 14 日內結清有關處理費及費用。

• Deposits are non-refundable once an order is confirmed.

• In the event of cancellation by the Customer, a handling fee will apply. The handling fee shall be determined by ARC based on the progress of the order, incurred costs, and any outstanding amounts.

• The Customer shall settle the handling fee and any related charges within 14 days of issuing a cancellation notice (including notices made by text, email, or other written communication).

4. Delivery Changes 送貨更改

• 如客戶於原定送貨當日臨時更改送貨日期或地址，本公司保留收取額外行政及運輸費用之權利。

• In the event that the delivery date or address is changed on the scheduled delivery day, the Company reserves the right to impose additional administrative and transportation charges.

​

5. Installation Service Disclaimer 安裝服務聲明

• 如客戶選擇使用 ARC Motorsport 的安裝服務，即表示客戶知悉並同意 ARC Motorsport 僅為硬件供應商。本公司並不會亦不會銷售或授權任何模擬器軟件、改裝軟件或相關數碼內容，除非該等軟件已由相關權利持有人授權作商業用途。

• ARC Motorsport 可於客戶要求下協助安裝軟件及改裝內容；惟所有相關費用、授權及責任均由客戶全權承擔。因客戶取得或使用該等軟件而產生的任何法律、技術或財務問題，本公司概不負責。

• If the Customer elects to use ARC Motorsport’s installation services, the Customer acknowledges and agrees that ARC Motorsport is solely a hardware provider. ARC Motorsport does not and will not sell or license any simulator software, modification software, or related digital content, except in cases where such software is licensed for commercial use by the respective rights holders.

• ARC Motorsport may, upon the Customer’s request, provide assistance with the installation of software and modifications; however, all associated costs, licenses, and responsibilities shall be borne entirely by the Customer. ARC Motorsport shall not be held liable for any legal, technical, or financial issues arising from the Customer’s acquisition or use of such software.

6. Software Download 軟件下載

• ARC Motorsport 可於客戶要求下，協助透過客戶本人的帳號下載模擬器軟件或改裝軟件。有關之授權或購買費用將列入客戶的發票。本公司不會亦不被視為該等軟件之銷售商或授權人。

• ARC Motorsport may, upon the Customer’s request, assist in downloading simulator software or modification software using the Customer’s own personal account. Any associated licensing or purchase costs will be added to the Customer’s invoice. ARC Motorsport shall not be deemed the seller or licensor of such software.

7. Limitation of Liability 責任限制

• ARC Motorsport 對於因使用、安裝或交付產品或服務而引致的任何間接、附帶或後果性損失，包括但不限於利潤損失、業務中斷或第三方索償，概不承擔責任。

​

• ARC Motorsport shall not be liable for any indirect, incidental, or consequential damages, including but not limited to loss of profits, business interruption, or third-party claims, arising from the use, installation, or delivery of products or services.

​

8. D-BOX Motion Platform Safety Disclaimer D-BOX 動態平台安全聲明

• 客戶承認 D-BOX 動態平台涉及物理動作，若使用不當或缺乏注意，可能導致風險。

• 因客戶使用或誤用 D-BOX 動態平台（包括但不限於安裝不當、疏忽或未遵循安全指引）而造成的任何傷害、意外或損失，ARC Motorsport 概不負責。

• 客戶須自行確保安全使用並遵循 D-BOX 所提供之安全指引。

​

• The Customer acknowledges that D-BOX motion platforms involve physical movement and may pose risks if misused or used without due care.

• ARC Motorsport shall not be liable for any injury, accident, or damage arising from the Customer’s use or misuse of D-BOX motion platforms, including but not limited to improper setup, negligence, or failure to follow safety instructions.

• Customers are solely responsible for ensuring safe use and compliance with safety guidelines provided by D-BOX.

9. Ownership & Risk 貨品所有權及風險

• 貨品所有權於全數付款後轉移至客戶。貨品風險於送達時轉移至客戶。

​

• Ownership of goods passes to the Customer upon full payment. Risk of loss or damage transfers upon delivery.

​

10. Force Majeure 不可抗力

• 如因供應商延誤、運輸中斷、自然災害或政府行為等超出 ARC Motorsport 合理控制範圍的情況導致延遲或未能履行責任，本公司概不承擔責任。

​

• ARC Motorsport shall not be liable for delays or non-performance due to events beyond its reasonable control, including but not limited to supplier delays, shipping disruptions, natural disasters, or acts of government.

​

11. Governing Law & Jurisdiction 適用法律及司法管轄權

• 本條款及細則受香港特別行政區法律管轄並依其解釋，任何爭議均須提交香港特別行政區法院專屬管轄。

​

• These Terms and Conditions shall be governed by and construed under the laws of Hong Kong SAR. Any disputes shall be subject to the exclusive jurisdiction of the courts of Hong Kong SAR.
